1. Seller
The Sourdine software is sold by Radnoumane MOSSABELY, [TO BE COMPLETED — legal status, e.g. sole trader], SIRET [TO BE COMPLETED], [TO BE COMPLETED — address]. Contact : sourdine@radnoumane.com.
2. Product
Sourdine is a native macOS utility distributed as an application (Sourdine.app). The application can be downloaded and installed for free ; the purchase is for a software license that activates the optimization engine (scheduling policy management, process freezing, fleet measurements). Without an active license, the application stays installed but the engine applies no policy.
The license is usable on all of the buyer's personal Macs.
3. Price
The price of the Sourdine license is 14,99 € VAT included, a one-time payment (no subscription), including upcoming updates to version 1.x. The product is offered for sale worldwide, billed in euros (EUR) regardless of the buyer's country. 4. Order and payment
Orders are placed online at sourdine.radnoumane.com. Payment is processed by Stripe, a secure payment provider ; Sourdine neither receives nor stores your card data. The sale is considered concluded once payment is confirmed by Stripe.
5. Delivery
Sourdine is a digital product delivered immediately after payment confirmation :
- a license key is automatically shown on the confirmation ("Thank you") page right after payment ;
- the same key is (or will soon also be) sent by e-mail to the address provided at purchase.
No physical medium is shipped. If you don't receive your key, contact sourdine@radnoumane.com with your Stripe receipt.
6. Right of withdrawal — digital content
Under article L221-18 of the French Consumer Code, consumers generally have a 14-day period to exercise their right of withdrawal on an online purchase.
However, as this concerns digital content not supplied on a physical medium, this right cannot be exercised, pursuant to article L221-28 13° of the French Consumer Code, once :
- performance of the contract has begun with the consumer's prior express consent (i.e. the immediate delivery of the license key) ; and
- the consumer has expressly waived their right of withdrawal.
By clicking "Buy" and completing payment, you expressly request immediate delivery of your license and acknowledge that you waive your 14-day right of withdrawal once the key has been delivered to you. This waiver applies independently of the commercial guarantee described in the next article, which offers you broader protection.
7. Voluntary commercial guarantee — 30-day refund
Beyond its legal obligations, and despite the waiver of the legal right of withdrawal above, the publisher voluntarily offers a 30-day money-back guarantee from the date of purchase, with no justification required. To claim it, simply write to sourdine@radnoumane.com (or reply to the Stripe receipt) within this window : the refund is issued to the same payment method, at no cost.
8. Legal warranty of conformity
Independently of the commercial guarantee above, the consumer buyer benefits from the legal warranties of conformity and against hidden defects provided under articles L217-3 et seq. and 1641 et seq. of the French Civil Code, which apply under ordinary law conditions.
9. Honest product description
Sourdine's features and behavior are precisely described on the home page and in the product documentation : process freezing (SIGSTOP, verifiable gain), E-core scheduling policies (preference passed to macOS via taskpolicy, with no guarantee of final placement by the scheduler), and energy estimates clearly labeled as such. The publisher commits to never presenting an estimate as a direct measurement.
10. Applicable law
These terms of sale are governed by French law, including for buyers located outside France, without prejudice to the mandatory consumer-protection provisions applicable in the buyer's country of residence within the European Union.
11. Disputes and mediation
In case of a dispute, the buyer is invited to first contact sourdine@radnoumane.com to seek an amicable solution. Failing agreement, the consumer has the right to use a consumer mediator free of charge :
